DGC 049 What Fathers Should Never Say in Court

July 3, 2026 | 17min

About this episode

When you’re fighting for custody of your kids, the wrong words at the wrong time can do serious damage to your case.

In Episode 049 of the Daddy Got Custody Podcast, I talk about the things fathers should never say in court—to the judge, attorneys, your ex, or even under your breath when you think nobody important is listening.

Family court can be emotional. You may be angry. You may believe you’ve been treated unfairly. You may even be absolutely right. But the courtroom isn’t the place to unload years of frustration. How you communicate can say as much about your ability to parent as the evidence you present.

We’ll talk about avoiding attacks on your ex, resisting the temptation to argue with the judge, keeping your answers focused, and understanding why statements like “She always…”, “She never…”, or “That’s not fair!” can hurt more than help.

The goal isn’t to walk into court and prove that your ex is a terrible person. The goal is to demonstrate that you are a stable, reasonable, prepared father who is focused on what’s best for your children.

I learned many of these lessons through my own custody journey and years of dealing with family court. If you’re preparing for a hearing, deposition, mediation, or trial, this is an episode you’ll want to hear before you start talking.

Because in family court, sometimes the most powerful thing a father can say is less.
