However, the lines can get blurry. For example, if you use inherited money for a down payment on the family home, that separate property might become “commingled” and treated as marital property. Properly defining separate and marital property is a fundamental part of any settlement negotiation.

Property division and child support are legally separate issues, but they can definitely affect each other. The financial outcome of your property settlement directly impacts your ability to provide for your children. For instance, the parent who keeps the family home will have different monthly expenses than the parent who moves into a new apartment.
A judge might consider each parent’s financial resources after the property is divided when setting child support amounts. If one parent receives significant assets that produce income, it could change the final support calculation. The main goal of child support is to make sure the children’s needs are met and that they can maintain a similar standard of living, so the overall financial picture of both parents is always relevant.
