How Louisiana Handles Child Custody
In Louisiana, custody cases are heard in the district court for the parish, or in a family court in parishes that have one, and judges decide custody based on the best interest of the child.
Louisiana law favors joint custody. When parents share joint custody, a 2026 change to state law says physical custody is to be shared equally unless the judge finds that is not feasible or not in the child’s best interest. The court usually names one parent as the domiciliary parent, the one the child primarily lives with, and that parent generally makes the final call on major decisions. Family violence can limit a parent’s custody and visitation.
Unmarried fathers: paternity must be legally established, through a formal acknowledgment or a court judgment, before a Louisiana father can ask the court for custody or visitation. Deadlines to file a paternity action can apply and may not be extended, so speak with an attorney early.
A Louisiana family law attorney can explain how these rules apply to your situation and what to expect in your parish’s court.
