How Kentucky Handles Child Custody
In Kentucky, custody cases are heard in circuit court, or in the family court division where a county has one, and judges decide custody based on the best interests of the child.
Kentucky law starts from a presumption that joint custody and equally shared parenting time are in the child’s best interest. A parent can overcome that presumption with evidence, and a judge who orders something other than equal time must set a schedule that maximizes each parent’s time while protecting the child. The presumption does not apply to a parent who has a domestic violence order entered against them.
Unmarried fathers: paternity must be legally established, through a signed voluntary acknowledgment of paternity or a court order, before a Kentucky father can ask the court for custody or parenting time. Without a court order, the mother is generally treated as the child’s legal custodian.
A Kentucky family law attorney can explain how these rules apply to your situation and what to expect in your county’s court.
