How to Choose the Right Family Law Attorney for Your Custody Case
Not All Family Law Attorneys Are the Same
One of the biggest mistakes I see fathers make is assuming that every family law attorney has the same experience, skills, and approach.
They don’t.
After spending more than 27 years helping fathers through custody disputes, I’ve seen outstanding attorneys change the direction of a case—and I’ve also seen fathers hire the wrong attorney simply because they picked the first name they found online.
Your choice of attorney can influence everything from temporary orders to the final custody arrangement.
Choose carefully.
Remember What’s at Stake
You’re not hiring someone to fix a speeding ticket.
You’re hiring someone to help protect your relationship with your children.
That’s one of the most important decisions you’ll ever make.
Price should be one factor.
It should never be the only factor.
Look for Someone Who Focuses on Family Law
If your case involves child custody, hire an attorney who regularly handles family law cases.
A lawyer who spends most of their time handling real estate closings or business contracts may be an excellent attorney—but that doesn’t necessarily make them the right choice for your custody case.
Family law changes frequently.
Experience matters.
Ask About Trial Experience
Here’s something many fathers don’t think about.
Most custody cases settle before trial.
But if your case doesn’t?
You need an attorney who is comfortable standing in front of a judge.
Ask questions like:
- How many custody trials have you handled?
- How often are you in family court?
- What types of custody cases do you typically take?
- Are you comfortable taking my case to trial if necessary?
Some attorneys are exceptional negotiators.
Others excel in the courtroom.
Ideally, you want someone who can do both.
Communication Matters
One of the biggest frustrations clients have is feeling left in the dark.
Ask how the attorney communicates.
- Phone
- Client portal
- Text messages
Also ask:
How quickly do you normally respond to clients?
Good communication reduces stress during an already stressful time.
Don’t Shop for the Cheapest Attorney
Everyone has a budget.
I understand that.
But remember the old saying:
“The bitterness of poor quality remains long after the sweetness of low price is forgotten.”
Hiring the cheapest attorney can sometimes become the most expensive decision you make.
I’ve watched fathers spend thousands trying to fix mistakes that could have been avoided from the beginning.
Read Reviews—but Read Between the Lines
Online reviews can be helpful.
Don’t just count the stars.
Read the comments.
Look for patterns.
Do former clients consistently mention:
- Good communication?
- Preparation?
- Honesty?
- Compassion?
- Strong courtroom skills?
One negative review isn’t necessarily a red flag.
A pattern of the same complaint is.
Ask Friends You Trust
Personal recommendations can be valuable.
If someone you know has been through a custody case, ask about their experience.
Questions like:
- Would you hire that attorney again?
- Did they keep you informed?
- Did they seem prepared?
- Were they realistic about expectations?
Real experiences often tell you more than advertisements.
Be Honest During the Consultation
Don’t hide facts because they’re embarrassing.
Your attorney can’t prepare for problems they don’t know about.
If there are mistakes in your past, discuss them.
If there are weaknesses in your case, talk about them openly.
Your attorney is there to prepare your best case—not to be surprised in the courtroom.
Watch for Warning Signs
Consider looking elsewhere if an attorney:
- Guarantees you’ll win.
- Promises sole custody before reviewing the facts.
- Doesn’t listen to your concerns.
- Rushes the consultation.
- Rarely returns calls or emails.
- Makes you feel like just another case file.
No ethical attorney can promise a specific outcome.
Be cautious of anyone who does.
You’re Hiring a Partner
The best attorney-client relationships are partnerships.
Your attorney understands the law.
You understand your children.
When those two perspectives come together, you build a stronger case.
- Bring organized records.
- Answer questions honestly.
- Respond quickly to requests.
The better client you become, the easier it is for your attorney to advocate for you.
One Final Thought
Earlier this week, I wrote about whether fathers should represent themselves in custody court.
My answer was simple:
Can you? Yes. Should you? Usually not.
If you’ve decided to hire an attorney, don’t simply hire the first one you find online.
Interview several.
Ask questions.
Do your homework.
This decision could affect your relationship with your children for years to come.
Choosing wisely today may be one of the best investments you ever make.
