How Maine Handles Child Custody

In Maine, custody cases are heard in the District Court, and the law uses the term parental rights and responsibilities rather than custody. Judges decide these cases based on the best interest of the child, and state policy is to assure children frequent and continuing contact with both parents.

A Maine court can order shared, allocated, or sole parental rights and responsibilities. When parents agree to share them, the court will make that award unless there is substantial evidence it should not. Judges also consider any history of domestic abuse between the parents.

Unmarried fathers: parentage must be legally established, through a signed acknowledgment or a court order, before a Maine father can ask the court for parental rights and responsibilities.

A Maine family law attorney can explain how these rules apply to your situation and what to expect in your county’s court.
