How Iowa Handles Child Custody

In Iowa, custody cases are heard in the district court, and judges decide custody based on the best interests of the child. The law favors arrangements that give the child the opportunity for maximum continuing contact with both parents, when that is reasonable and safe.

Iowa courts must consider joint custody when a parent asks for it, and a judge who denies joint legal custody must explain why. A parent can also ask for joint physical care, where the child lives with both parents, and the court must explain any denial of that request as well. A history of domestic abuse can create a presumption against joint custody.

Unmarried fathers: paternity must be legally established, through a signed affidavit of paternity or a court order, before an Iowa father can ask the court for custody or visitation.

An Iowa family law attorney can explain how these rules apply to your situation and what to expect in your county’s court.
