How Idaho Handles Child Custody
In Idaho, custody cases are heard in the magistrate division of the district court, and judges decide custody based on the best interests of the child. The court looks at factors such as the wishes of each parent, the child’s relationship with each parent, and the child’s adjustment to home, school, and community.
Idaho law presumes that joint custody is in the child’s best interest, unless a parent shows otherwise. The court considers the child’s wishes. A parent found to be a habitual perpetrator of domestic violence faces a presumption against being given joint custody.
Unmarried fathers: paternity must be legally established, through a signed acknowledgment of paternity or a court order, before an Idaho father can ask the court for custody or visitation.
An Idaho family law attorney can explain how these rules apply to your situation and what to expect in your county’s court.
