How Hawaii Handles Child Custody
In Hawaii, custody cases are heard in the Family Court of the circuit where the child lives, and judges decide custody based on the best interests of the child. The court looks at factors such as each parent’s history of caring for the child, the child’s needs, and each parent’s willingness to support the child’s relationship with the other parent.
Hawaii courts can award joint or sole custody, and the court considers the child’s wishes if the child is old enough to form a sound opinion. A parent with a history of family violence faces a presumption against being given custody.
Unmarried fathers: paternity must be legally established, through a signed acknowledgment of paternity or a court order, before a Hawaii father can ask the court for custody or visitation.
A Hawaii family law attorney can explain how these rules apply to your situation and what to expect in your county’s court.
